User Agreement and Terms of Service
These Services are provided by La Factoría Bike-In SL ("Bike-In", "we" or "us"). By using our Services—including creating an account, using the app, registering vehicles or promotions, and accessing our vehicles—you confirm you have the legal capacity to enter into binding contracts and accept these Terms.
Bike-In reserves the right to amend these Terms at any time. Revised Terms apply once you expressly accept them in the app. You may stop using the Services at any time; Bike-In may also terminate your access at our discretion. For any queries, contact us at info@smartciti.es.
Our "Services" include the Bike-In mobile app, electric bicycles and standard bicycles, our websites, customer support, and any other technology or service we make available.
We are not a public transport provider; our Services are a convenience for eligible users, and alternative transport options are available.
To use most Services you must register and maintain an active personal account, which requires a valid payment method and other information depending on the Service. Information you provide must be truthful, accurate and kept up to date. Your account is personal and non-transferable; you are responsible for all activity on it. Notify us immediately of any unauthorised use.

Reservations. You may use the App to locate, reserve and rent available vehicles. The price will be shown before the trip begins. Bike-In reserves the right to accept or decline reservation requests; if a charged reservation is declined, the applicable refund will be issued.
Age and eligibility. You must be at least 18 years old or of legal age where applicable. Where local regulations permit, users aged at least 16 may use the Services with the express consent of a parent or legal guardian, who assumes responsibility for their activity.
Usage requirements:
Safety checks. Before using any vehicle, check the brakes, overall condition of the frame and wheels, tyre inflation, and—for electric bicycles—the battery level. If you notice any fault, do not use the vehicle and report it to us at info@smartciti.es or by calling +34 647 816 272.

Parking. At the end of your trip, park the vehicle upright in the zones indicated in the App, ensuring it does not obstruct traffic or access routes.
Damage. Subject to fair wear and tear, return the vehicle in the same condition in which you received it. If you damage a vehicle or fail to return it within 48 hours, you will be liable for repair or replacement costs up to a maximum of €1,797 for electric bicycles and €800 for standard bicycles. You will be informed of any charge in advance and given the opportunity to respond.
Rental period. The maximum rental period is 90 minutes unless the App states otherwise. You may re-rent the vehicle once the period has elapsed.
Services may be used on a per-trip or subscription basis. All prices are shown in the App and include applicable taxes. Time is billed per started minute. Charges will be applied to the payment method on your account.
We may update pricing at any time. For subscriptions, we will notify you in writing at least 14 days in advance of any material change.
If you dispute a charge, contact us as soon as possible at info@smartciti.es with the approximate date and times of the trip.
You have the right to cancel your subscription within 14 days of the acceptance confirmation. If you have used the Service during that period, any refund will be proportional to the unused days. To cancel, write to us at info@smartciti.es.
Nothing in these Terms limits Bike-In's liability for death or personal injury caused by our negligence, for fraudulent misrepresentation, or for any liability that cannot be limited by law.
Otherwise, and to the extent permitted by applicable law, Bike-In's liability is capped at €85 for direct, reasonably foreseeable losses. Our vehicles are machines with inherent risks; by using them you accept those risks and are responsible for any damage you cause to third parties or their property, unless the direct cause is an act or omission on our part.
You are responsible for all claims, costs and damages arising from your breach of these Terms, misuse of the Services, or infringement of third-party rights. This responsibility survives termination of the agreement.
The collection and use of your personal data is governed by our Privacy Notice, available on our website or upon request at info@smartciti.es.
Bike-In grants you a limited, non-exclusive, revocable and non-transferable licence to access and use the App and Services on your personal device. All rights not expressly granted are reserved. You may not copy, modify, distribute, sell or reverse-engineer any part of the Services.
These Terms are governed by Spanish law. If you are a consumer resident in the EU, you also benefit from the mandatory provisions of the law of your country of residence.
If a dispute cannot be resolved directly with us, you may refer it free of charge to your local Consumer Information Office (OMIC), or use the EU online dispute resolution platform: http://ec.europa.eu/consumers/odr.
Any litigation not resolved by the above means shall be subject to the exclusive jurisdiction of the Spanish courts.
